Matrimonial Mediation

The New York County Matrimonial Mediation Program links divorcing couples to trained mediators to help them reach agreements on parenting and economic matters.

Matrimonial mediation is a dispute resolution process in which a neutral third party (referred to as a mediator) helps parties communicate, identify issues, clarify perceptions, and explore options for a mutually acceptable outcome.

Mediation is a confidential, voluntary process that is driven by the parties involved. Mediators do not make decisions regarding the outcome of the case, allowing the parties to maintain control over the resolution. Additionally, mediation can save both time and money.

Matrimonial Neutral Evaluation

The Matrimonial Neutral Evaluation Program (MNEP) offers parties access free of charge to qualified Neutral Evaluators. The goal of the MNEP is to assist the parties and their counsel in reaching a resolution on a discrete issue or issues. Although parties are not obligated to settle in Neutral Evaluation, parties often resolve the discrete issue or issues referred to the Neutral.

In neutral evaluation, a neutral third party (the neutral evaluator) hears abbreviated case presentations by the parties and counsel, provides an informal assessment of the strengths and weaknesses of the arguments and offers a non-binding opinion of likely court outcomes.

Neutral evaluators have significant experience in matrimonial law and specific training in neutral evaluation. Their assessments and opinions may help parties to analyze the case, facilitate discussion, resolve the issue(s) referred to neutral evaluation, and generate a settlement.
