PURPOSE OF THE COURT

Integrated Domestic Violence (IDV) courts are a specialized part of Supreme Court where all criminal, family and matrimonial (divorce) cases involving a family affected by intimate partner violence are assigned to one judge. IDV courts are dedicated to the idea of “one family, one judge.” IDV courts facilitate comprehensive information about family issues for judicial decision making and referring families to appropriate resources and services. Bringing court staff and key partners together is critical to identify potential challenges and coordinate effective case management and operations for the IDV court.

The goals of the IDV Court are to promote family safety and judicial decision making, provide consistency is orders of protection, reduced appearances, enhance services to survivors of domestic violence and increase offender accountability, while protecting the rights of all litigants. 


COURT TRANSFER

The IDV Court hears interrelated cases from throughout Chenango County.  The requirement for the entry into IDV Court is a pending criminal case involving allegations of domestic violence or a violation of an order of protection between the alleged survivor and a defendant in addition to either a Family Court matter and/or a contested matrimonial matter between the parties.  

All such domestic violence cases from Chenango County Town, Village or City Courts may be transferred from the local court to the IDV Court, provided that no case has been pending so long in the originating court that the transfer would not promote the administration of justice.  Upon identification of appropriate cases, the IDV Court will issue a mandatory Transfer/Removal Order notifying the parties and originating local courts that the matters have been transferred.  Once the parties have been notified, they need only to appear in IDV Court for the pending matters.
