PROBATE - Decedent Left a Will (and estate assets of more than $50,000.00)

ADMINISTRATION - Decedent did NOT leave a Will (and estate assets of more than $50,000.00)

SMALL ESTATE - personal property only (no real property) estate assets of less than $50,000

 

How To Proceed When A Loved One Needs A Guardian

ARTICLE 17 GUARDIANSHIP - Child under the age of 18 and receiving over $10,000

ARTICLE 17-A GUARDIANSHIP - Intellectually/Developmentally Disabled

ARTICLE 81 GUARDIANSHIP - Incapacitated Adult

* Although Family Court has concurrent jurisdiction, as a matter of local policy in Broome County all 17 and 17A Guardianships are filed in Surrogate’s Court. 
* Supreme and County Court has jurisdiction over Article 81 proceedings, they are to be filed with the Broome County Clerk.
