The room, time and day of the week that your motion must be noticed for differs depending on which county your case is in.
The Part number that your motion must be noticed for is the same in every county and depends on whether you are making a procedural or non-procedural motion. Non-procedural motions are noticed to be heard in Part 35. In a non-procedural motion, the relief you are requesting in the motion falls under one of the following categories:
CPLR 3211 Motion to dismiss,
CPLR 3212 Motion for summary judgment,
CPLR 3213 Motion for summary judgment in lieu of complaint, or CPLR 7510 Motion to Confirm an Award.
A procedural motion is where the relief you are requesting in your motion is for anything other than the above categories. Procedural motions are noticed to be heard in Part 34.
