An Extreme Risk Protection Order (ERPO) is a court order issued when a person may be dangerous to themselves or others. An ERPO prohibits a person from purchasing or possessing guns and requires the person to surrender any guns they already own or possess. An ERPO can also direct the police to search a person, premises or a vehicle for guns and remove them. An ERPO case may be started by a district attorney, a police officer, a school official, or a member of the person’s family or household. It is a civil case. 22 NYCRR 202.5(e)) requires attorneys to omit or redact certain confidential personal information from court filings in Supreme and County Court. This rule became mandatory on March 1, 2015. The rule covers both e-filed and paper-filed cases. Please refer to the NYSCEF site for information for e-filed cases. Matrimonial actions, proceedings in Surrogate’s Court or proceedings pursuant to Article 81 of the Mental Hygiene Law are excepted from Rule 202.5(e). The Unified Court System recommends a new form “Redaction Cover Page” included here for use by persons filing paper-filed court papers regarding confidential personal information subject to the rule. |
