The NYSCEF Resource Center of the New York State Unified Court System, is pleased to announce that an updated Stipulation which permits the Electronic Filing of Tax Certiorari Petitions using the Data Upload method via NYSCEF for counties in NYC, has been finalized. A PDF version of this year’s stipulation with exhibits is found here 2020 Stipulation with Exhibits [pdf]. As in the past, one stipulation covers filings in all counties within the City of NY. Please review this year’s stipulation carefully and note that each stipulation must be signed by the New York City Law Department (pursuant to the above instructions) before being submitted to the NYSCEF Resource Center.

Also attached are the instructions/procedures that must be followed for an Attorney to be authorized this year to E-File Tax Certiorari Petitions using the Data Upload method. Please review and follow the instructions carefully and contact the NYSCEF Resource Center with any questions you have regarding the NYSCEF program.

 

REMINDER: Even if you have previously signed and filed a stipulation and have utilized the Data Upload Filing method in a prior year, you must still follow the procedures set forth in the attached instructions titled: “Commencement of Tax Certiorari proceedings using the Electronic Filing System 2020 Instructions " to participate again this year.

Please note: Paragraph 1 of the stipulation reads “Petitioners shall efile their petitions and purchase an index number for each such petition before October 24, 2020. The Court shall not accept a petition efiled/uploaded after this deadline.”

Please be aware that while every precaution will be taken to assure that the NYSCEF system will be available for E-Filing Tax Cert petitions until 11:59pm on Friday October 23, 2020, there is always the risk of a technical failure that can impact the ability to file on time. In addition, the County Clerk Offices, Supreme Courts, and the E-Filing Resource Center will be closed after business hours on Friday October 23, 2020. Should petitioners encounter any issues with respect to uploading their text files/petitions after regular business hours, there will be no one available at the court to assist them. Therefore, we strongly encourage petitioners, to every extent possible, complete all filings by close of business on Friday October 23, 2020. Also, it is especially important that petitioners choosing the pay at courthouse method, where available, allow themselves enough time to get to the County Clerk’s Office and deliver payment to complete their filing before close of business on Friday October 23, 2020.

This year we will not be able to offer in-person training, however we have scheduled 2 – 1 hour online sessions via Microsoft Teams. At each session we will review the Stipulation, instructions, and demonstrate the E-Filing processes, and answer any questions you may have.

This 1 hour class reviews the basics of E-Filing Tax Cert Petitions with an emphasis on the Data Upload Method.

We are happy to offer 1.0 FREE Continuing Legal Education (CLE) credit to qualified attorneys who complete the full session.
