Overview

Surrogate’s Court has jurisdiction over actions and proceedings of decedents, including the probate of a last will and testament, intestate estates, small estates, ancillary proceedings, disputed claims, discovery proceedings, accountings, wrongful death compromise and settlement actions, inter vivos and testamentary trusts, guardianship proceedings of person and/or property of infants and Article 17/A, as well as private and agency adoptions.

Records of decedents are on file and available to the public for viewing and copying. A number of records are scanned into the public access computer and we are currently in the process of scanning older files into the computer as well.

 

Local Practices

This Court requires that a Family Tree form be completed for ALL filing types except for an
adoption. It can be found under Miscellaneous forms on the forms website.

This Court will not accept original forms with white-out or correction tape on them. If changes must be made they should be crossed out and initialed OR a new form completed.

If filing a Small Estate (a/k/a Voluntary Administration) proceeding the total estate assets must total less than $30,000.00, and cannot include real estate.
