**PLEASE NOTE:  This Surrogate’s Court is now requiring Mandatory E-Filing for ALL estate proceedings.  If you are not able to file electronically then you must submit form SCM-2 Notice of Opt-Out of Mandatory E-Filing which can be found on the court forms website.

 
 

Overview

Surrogate’s Court has jurisdiction over actions and proceedings of decedents, including the probate of a last will and testament, intestate estates, small estates, ancillary proceedings, disputed claims, discovery proceedings, accountings, wrongful death compromise and settlement actions, inter vivos and testamentary trusts, guardianship proceedings of person and/or property of infants and Article 17/A, as well as private and agency adoptions.

Records of decedents are on file and available to the public for viewing and copying. A number of records are scanned into the public access computer and we are currently in the process of scanning older files into the computer as well.

WebSurrogate is a web-based file search and document retrieval solution that provides information on estate proceedings and other 
filings within New York State Surrogate’s Courts and is now available on the internet! 

It is a free service that allows users to search estate files, retrieve associated documents, and view historical estate records that are considered public information. Please review the HELP link in this program for important additional information. 

 

Local Practices

This Court requires that a Family Tree form be completed for ALL filing types except for an adoption. It can be found under Miscellaneous forms on the forms website.

This Court will not accept original forms with white-out or correction tape on them. If changes must be made they should be crossed out and initialed OR a new form completed.

If filing a Small Estate (a/k/a Voluntary Administration) proceeding the total estate assets must total less than $50,000.00, and cannot include real estate.

If you are filing an Ancillary Probate or Ancillary Administration Petition, please be sure to follow Form AU-67 and file the NYS Department of Taxation forms ET-20 and ET-141 with the Tax Department before filing your Petition with the Court.  Once you receive the signed Stipulation Reserving Domicile and Waiver and Consent from the Tax Department please file those along with your Petition, Exemplification and death certificate with the court.  This will ensure a faster turnaround of the Decree and Letters.
