Except as indicated below, all emails shall contain the index number and name of the case in the subject line, and all parties must be copied.

The Court will not entertain any Ex Parte communications.

Emails are preferred and will be responded to more quickly than telephone calls.

PART FRP-1 (MOTIONS)

  1. ALL MATTERS BEFORE JUSTICE CENCERIA P. EDWARDS ARE IN-PERSON AT 360 ADAMS STREET, BROOKLYN, NY 11201, COURTROOM 756.
  2. MOTIONS ARE HEARD ONLY ON WEDNESDAYS, with a SINGLE CALENDAR CALL AT 10:30 A.M.  ALL PARTIES MUST APPEAR ON TIME AT THE START OF CALENDAR CALL.

***AS OF January 3, 2024, CALENDAR CALL IS 10:00 A.M. WEDNESDAYs ONLY***

  1. AT CALENDAR CALL, (for cases NOT E-FILED) Movants must bring a hard copy of a Proposed Order on the motion’s return date, along with exhibits that support and are decisive for the motion.
  2. Motions can only be adjourned upon stipulation signed by both parties. Only one (1) such stipulated adjournment is permitted.  Stipulations of adjournment must be filed with the Court at least one (1) week prior to the return date, under the appropriate motion sequence number, and a copy must be emailed to the Part at KSCCVFRP1@nycourts.gov.
  3. The Court will consider conferencing cases forthwith that are not calendared for motion appearance where the parties contemplate settlement and have failed to reach an agreement within their last 60 days of discussions. Both parties shall email the Part at KSCCVFRP1@nycourts.gov.
  4. All stipulations of SETTLEMENT shall be fully executed and either e-filed or submitted to the County Clerk, with a copy emailed to the Part at least one week prior to the return date (if a motion is pending).
  5. Orders to Show Cause are reserved for emergency applications ONLY.
  6. Except for e-filed motion papers, the uploading of correspondence and documents to NYSCEF shall not constitute a submission for the Court’s consideration unless the party emails a copy to the Part at KSCCVFRP1@nycourts.gov.
  7. Applications for a Substitute Referee or Newspaper, or to Extend the Time for a Foreclosure Sale may be submitted as EX PARTE Orders.  There shall be no submissions of documents to be “so ordered” or which request the Justice’s signature, if the relief requested requires leave of the Court.
  8. Proposed Orders for a Discontinuance must state the reason why the action is being discontinued and must contain the requisite language: directing the County Clerk of Kings County to Cancel and Discharge the Notice of Pendency (give specifics) and directing Clerk to enter same upon the margin of the record of the same Notice of Cancellation referring to this Order.

Pro Se/Self-Represented Defendant

Volunteer lawyers are available during the motion calendar call and in the courthouse to provide limited legal counsel, at the least, during the mandatory settlement conference and motion phase of the action.

For all litigants there is information on the court’s website regarding foreclosure litigation in New York State Courts.

Defendants may meet with housing counseling agencies. Information about volunteer attorneys and other resources can be found on the Court’s website at: www.nycourthelp.gov. Defendants may retain hired or volunteer Counsel prior to participating in any court hearings and/or mandatory settlement conferences. Any Stipulation of Settlement with a Pro Se/Self-represented Defendant must be “So Ordered” by the Court.

PART 8 (TRIALS)

  1. Notify the Part Clerk if an interpreter is required one week prior to trial; Email KSCCVFRP1@nycourts.gov, CC all parties, with “INTERPRETER REQUEST” (in all caps), the Index Number, and the trial’s start date in the Subject Line.  The Case Caption and Index Number must also be set forth in the first line of the body of the email.
  2. All parties must attend a settlement conference one week prior to trial but may request it earlier, via email at KSCCVFRP1@nycourts.gov, CC all parties, with “SETTLEMENT CONFERENCE REQUEST” (in all caps) and the Index Number in the Subject Line.  The Case Caption and the Index Number must also be set forth in the first line of the body of the email.
  3. At least three (3) weeks prior to trial, Litigants must submit the marked pleadings, Trial Intake Sheet, and Exhibit List by email to KSCCVFRP1@nycourts.gov, copied to all parties, with “TRIAL PACKET” (in all caps) and the trial’s start date in the Subject Line.  The Case Caption and Index Number must also be set forth in the first line of the body of the email.
  4. Any motions in limine, by any party on either side, are subject to the same deadline (submit three (3) weeks prior to trial) and must be submitted in the same manner.
  5. All proposed jury charges and verdict sheets shall be submitted to the court in typed form ONE WEEK prior to trial.
