IDV Part Rules

General Rules

All parties and counsel must appear for calendared matters unless specifically excused by the Court.

Conferences and calendar calls start at 9:30 a.m.

 

Criminal Cases

If a case is marked ready for trial or hearings and either the Assistant District Attorney or defense counsel does not expect to be ready, counsel shall notify opposing counsel 24 hours in advance to avoid inconvenience to witnesses. Failure to comply may result in sanctions being imposed.

Motions and answering papers shall be filed with the Supreme Court Motion Clerk.

 

Family Court

All parties and counsel must appear unless specifically excused by the Court.

Motions and answering papers shall be filed with the IDV Clerk.

 

Matrimonial

Preliminary Conferences

The parties must provide the Court and opposing counsel with financial disclosure as required by the Uniform Rules for the New York State Trial Courts (22 NYCRR § 202.16).

These papers must be exchanged between the parties and filed with the Court no later than 10 days before the Preliminary Conference unless the Court directs otherwise. Counsel shall also provide the Court with copies of the verified complaint and answer and the attorneys’ retainer agreements.

Before the call of the calendar, counsel will begin completing the preliminary conference order form which is available from the Clerk of the Part.

Failure to appear in any action may result in costs or sanctions being imposed against the defaulting party.

Compliance Conferences

Counsel attending shall be fully familiar with the case and must have the authority to settle or dispose of the action.

Motions

Motions and counterclaims shall be submitted to the Matrimonial Clerk’s Office, 88–11 Sutphin Boulevard, Jamaica, New York 11435. Answering papers may be filed in the IDV Clerk’s Office in Kew Gardens. All motion practice shall conform to the Uniform Rules for the New York State Trial Courts and the CPLR.
