Brookhaven Town Ordinance - Suffolk County Sixth District Court

 

Brookhaven Town Code offenses are prosecuted by the Brookhaven Town Attorney. The Town Attorney appears in court on Thursdays. Pre-arraignment conferences are in a hearing room.  Defendants or their attorneys conference with the prosecuting Town Attorneys before they appear before the Judge in the Main Courtroom. If you conference with the Town Attorney but do not appear before the Judge, you may be subject to a warrant or a default.

The Courthouse opens at 9:15am. The Town Attorneys conduct conferences in the order that you have signed-in on their sign-in sheet.

The Court Clerk has the authority to accept guilty pleas and impose sentence for certain Town Code offenses:

§ 13-12 $100 improper mooring
§ 23-3A $50 dog without license
§ 23.3H . . . $50 dog at large
§ 23-3G $50 dog without collar
§ 37-2 $250 operation of ATV all-terrain vehicle
§ 49 B-11 $100 public urination, etc
§ 50-6 . . . $75 noise violation
§ 74- 6 $200 vessel speed limits in PJ Harbor
§ 74- 8 $100 general prohibitions in PJ Harbor
§ 74-11 $100 mooring prohibitions in PJ Harbor
§ 76- 4(c)(6) $100 walking on dunes
§ 77-11 $100 prohibitions in nature preserve (subdivisions a b c e f g k l)
§ 83-10 $100 carts w/o permit on wooden walk

To plead guilty by mail:

  • Complete and sign the back of the ticket, with a
  • check or money order for the fine (payable to the CLERK OF THE COURT)
  • Include a Stamped self addressed envelope for your receipt.

After you are sentenced, fines may be paid online at payments.nycourts.gov. You cannot plead guilty online.
